Terms of Service

These Terms of Service (the “Terms”) form a legally binding agreement between you (the “Guest”) and Burj Vista Residences LLC(operating as “Burj Vista”, “we”, “us”, or “our”) and govern your use of this site and any booking, reservation, or stay at any of our apartments. By using the site or completing a booking, you accept these Terms in full. If you do not accept them, you must not use the site or make a booking.

1. Eligibility and identity verification

You must be at least 18 years old and have the legal capacity to enter into a binding contract to make a booking. The lead guest is solely responsible for the conduct of every guest in the booking and for full payment.

At check-in, the lead guest must present a valid government-issued photo ID, and we may require ID for every adult guest to comply with hospitality and tourism regulations in AE. We reserve the right to refuse check-in without refund where ID cannot be verified, where the guest information differs materially from the booking, or where we believe the booking is fraudulent.

2. Booking, confirmation, and modifications

A booking is binding only once payment has been processed in full and you have received a confirmation email containing a booking reference. Until that point we may decline a request at our sole discretion — including where the apartment is no longer available, where the price was incorrectly quoted due to a clear error, or where we suspect fraud or abuse.

Modifications to confirmed bookings (dates, guest count, apartment) are accommodated where reasonably possible and at our sole discretion, subject to availability and a rate adjustment to the prevailing rate. We are not obligated to honour modification requests.

3. Pricing, taxes, currency, and payment

  • All prices are in AED. Prices displayed in another currency are for indicative purposes only; the final amount charged is in AED and your bank may apply conversion fees.
  • Unless explicitly stated otherwise, prices include applicable VAT and tourism dirham; municipal fees, parking, breakfast, and similar extras are charged separately at the rates posted at the property.
  • Payment in full is taken at the time of booking. We may also place a pre-authorisation hold for incidentals at check-in (typically up to AED 1,500 per night, released within 7 working days of check-out).
  • You authorise us to charge the payment method used at booking for any amounts payable under these Terms — including damages, additional fees, and unrecoverable losses — without further notice.
  • If a payment is reversed, charged back, or otherwise cannot be collected, we reserve the right to cancel the booking and recover the amount through any lawful means; collection costs are payable by you.
  • Promotional rates are non-refundable, non-transferable, and may carry additional restrictions stated at booking.

4. Cancellation, no-show, and shortened stays

Each apartment’s cancellation window is shown on the apartment page and on your booking confirmation. Cancellations are governed strictly by that window:

  • Inside the free-cancellation window: a full refund less any non-refundable fees disclosed at booking.
  • Outside the free-cancellation window: 100% of the total booking amount is forfeited.
  • No-show: if you do not arrive on the check-in date and have not contacted us in writing in advance, the booking is treated as cancelled and 100% of the total is forfeited.
  • Early check-out: shortening a confirmed stay does not entitle you to a refund of the unused nights, regardless of reason.
  • Promotional / non-refundable rates: are not refundable under any circumstances, including changes to plans, illness, visa issues, or travel disruption.

Refunds, where due, are processed to the original payment method within 14 working days. Bank or card-network delays beyond our control are not our responsibility.

5. Check-in, check-out, and late departure

Standard check-in is from 3:00 PM and check-out is by 11:00 AM local time. Early check-in or late check-out may be available on request and are at our sole discretion. Unauthorised late departure beyond 11:00 AM is charged at AED 200 per hour or part thereof; departure beyond 1:00 PM may be billed as an additional full night at the prevailing rate.

6. House rules

The following rules apply to every stay. Any breach is grounds for immediate eviction without refund, in addition to any monetary penalties.

  • No smoking of any kind (cigarettes, vapes, shisha) anywhere inside the apartment, balcony, or common areas. Breach: minimum AED 1,500 cleaning & restoration fee.
  • No parties or events. Breach: minimum AED 5,000 plus the cost of any damage and immediate eviction.
  • Quiet hours are observed between 10:00 PM and 8:00 AM. Repeated noise complaints may result in eviction without refund.
  • Maximum occupancy stated on the listing is strict. Unauthorised additional guests are charged at AED 250 per person per night and may result in eviction.
  • No pets unless arranged in writing in advance. Unauthorised pet: minimum AED 1,000 deep-clean fee.
  • No subletting, commercial use, photography for commercial purposes, or filming without our prior written consent.
  • No illegal activity. Guests must comply at all times with the laws of AE. Any incident may be reported to authorities and the booking terminated immediately without refund.

7. Additional fees schedule

The following additional fees may be charged at our discretion. Where multiple apply, they are cumulative.

  • Lost key / access card: AED 500 per item
  • Lockout call-out (after-hours): AED 300
  • Excessive cleaning beyond ordinary use: from AED 500
  • Smoking inside the apartment: from AED 1,500
  • Unauthorised pet: from AED 1,000
  • Late checkout (per hour): AED 200
  • Failed pre-authorisation re-attempt or chargeback: AED 250 admin fee plus the disputed amount

8. Damage, security deposit, and direct billing

Guests are strictly liablefor any loss, breakage, theft, or damage to the apartment, its contents, or the building’s common areas caused during their stay, beyond ordinary wear and tear, regardless of which guest in the booking caused it.

Where a security deposit is taken, we may apply it against any sums due. Where damages exceed the deposit (or no deposit was taken), you expressly authorise us to charge the difference to the payment method used at booking, supported by photographs and an itemised statement, without further consent. Where amounts cannot be collected electronically, you remain personally liable and we reserve the right to pursue recovery through legal means; collection costs and reasonable legal fees are payable by you.

9. Right to refuse service and immediate eviction

We reserve the right, in our sole discretion and without prior notice, to:

  • Refuse a booking, decline check-in, or cancel a confirmed booking before arrival.
  • Terminate a stay early and require guests to vacate immediately, with no refund of any unused nights, where there is a breach of these Terms, unsafe or unlawful behaviour, significant damage, disturbance to neighbours or staff, or where we reasonably believe the booking has been obtained fraudulently.
  • Recover from the Guest the cost of any damage, additional cleaning, lost revenue from rendering the apartment unusable, and reasonable legal and administrative costs.

10. Indemnification

You agree to indemnify, defend, and hold harmless Burj Vista Residences LLC, its affiliates, owners, officers, employees, and agents from and against any and all claims, demands, losses, damages, costs, expenses (including reasonable legal fees), and liabilities arising out of or relating to: (a) your or your guests’ use of the apartment or the site; (b) any breach of these Terms; (c) any violation of law; (d) any negligent or wilful act or omission; or (e) any claim by a third party arising from the foregoing.

11. Limitation of liability

To the maximum extent permitted by applicable law:

  • Our total aggregate liability to you for any claim arising out of or relating to your booking, your stay, or your use of the site — whether in contract, tort, statute, or otherwise — is capped at the total amount you have paid for the booking concerned.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profit, loss of business opportunity, loss of enjoyment, loss of holiday value, or loss of data, however caused.
  • We are not liable for personal belongings, valuables, cash, electronics, or documents brought into the apartment. Use the in-room safe where provided. We strongly recommend appropriate travel insurance.
  • We are not liable for any disruption, inconvenience, or loss caused by the building’s common-area services, utilities, internet outages, lifts, climate control, or third-party providers.
  • Nothing in these Terms limits liability for death or personal injury caused by our gross negligence, for fraud, or for any other liability that cannot lawfully be limited.

12. Disclaimer of warranties

The site and the apartments are provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all warranties, whether express, implied, statutory or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

13. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, fire, flood, sandstorms, government action or requisition, public-health emergencies, civil unrest, terrorism, war, strikes, utility outages, or service disruptions affecting the site or the property. Where such an event prevents us from honouring a booking we will offer a credit, alternative apartment, or refund at our sole discretion.

14. Communications and marketing

You consent to receiving service-related communications by email, SMS, and (where you provide a number) WhatsApp, in connection with your booking — including confirmations, check-in instructions, and post-stay messages. Marketing communications are sent only with your opt-in consent and you may unsubscribe at any time.

15. Intellectual property

All content on this site — including text, photographs, logos, floor-plans, and the site design — is owned by Burj Vista Residences LLC or our licensors and protected by copyright and trademark law. You may not reproduce, republish, sell, or otherwise exploit it without our prior written consent.

Reviews, photographs, or other content you submit through the site remain yours, but you grant us a worldwide, royalty-free, perpetual, non-exclusive licence to use, copy, display, and distribute them for the purpose of operating, promoting, and improving our service.

16. Privacy

We process personal data in line with our Privacy Policy, which is incorporated into these Terms by reference. By using the site or making a booking you acknowledge having read it.

17. Governing law, jurisdiction, and dispute resolution

These Terms are governed by and construed in accordance with the laws of AE. Any dispute, controversy, or claim arising out of or relating to these Terms, your booking, or your use of the site shall first be the subject of good-faith discussion between the parties for at least thirty (30) days.

If not resolved, the dispute shall be referred to and finally resolved by arbitration administered by the Dubai International Arbitration Centre (DIAC) under its rules in force at the time of the dispute. The seat of arbitration is Dubai, the language is English, and the tribunal shall consist of a sole arbitrator. The award is final and binding on the parties.

Where arbitration is unavailable or unenforceable, the courts of Dubai,AE shall have exclusive jurisdiction. You agree not to bring any action in any other court.

18. Class action and jury trial waiver

You agree to bring any claim against us only on an individual basis, and not as a plaintiff or class member in any purported class, consolidated, or representative action. To the extent permitted by law, you and we each waive the right to a trial by jury.

19. Limitation period

Any claim arising from your booking or stay must be brought within twelve (12) months of the cause of action arising, failing which the claim shall be permanently barred.

20. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be replaced by an enforceable provision that most closely reflects the original intent.

These Terms, together with the Privacy Policy and any additional terms referenced at booking, constitute the entire agreement between you and us regarding the subject matter and supersede any prior agreement or understanding.

21. Changes to these Terms

We may amend these Terms at any time. The version in force when you make a booking governs that booking. Continued use of the site after a revised version is published constitutes acceptance of the changes for future bookings.

22. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely, including to an affiliate or in connection with a corporate reorganisation or sale.
